Terms of Service

1. Acceptance of Terms

By accessing or using the Baristta platform, available at app.baristta.tech, you agree to these Terms of Service. If you do not agree with any condition, do not use the platform.

These terms constitute a binding agreement between you ("Client", "you") and Baristta ("we", "our", "Baristta"), a product of Macchiatto Tecnologia.

2. Description of Services

Baristta provides the following web infrastructure monitoring services:

• FTP Monitoring: file change detection via FTP, SFTP and FTPS
• Page Verification: integrity monitoring and availability of web pages
• Database Backup: automated backups of MySQL and PostgreSQL databases
• FTP Backup: automated backups of files stored on FTP servers

3. Registration and Account

• You must provide truthful and complete information when creating your account
• You are responsible for maintaining the security of your access credentials
• You must notify Baristta immediately of any unauthorized use of your account
• An account represents a company or organization; sharing between entities is not permitted

4. Client Responsibilities

4.1. System Credentials

The Client is fully responsible for the accuracy and validity of credentials provided for monitoring (FTP passwords, database passwords, website access credentials). Incorrect or expired credentials may prevent service execution, and Baristta is not responsible for failures resulting from invalid credentials.

4.3. Access Authorization

By providing server and system credentials, the Client declares that they have legitimate authorization to access and monitor such systems. Baristta is not responsible for monitoring of systems for which the Client does not have proper authorization.

4.4. Acceptable Use

The Client agrees not to use the platform for:

• Illegal activities or activities that violate third-party rights
• Monitoring systems without the owner's authorization
• Intentionally overloading the platform's infrastructure
• Attempting to access other clients' data or restricted areas of the platform

5. Availability and Warranties

Services are provided "as is", with best effort to maintain availability and quality. Baristta commits to the operation described in our Service Commitments, but does not offer absolute guarantees of uninterrupted availability.

Baristta is not liable for:

• Data loss in the Client's systems
• Failures resulting from invalid or expired credentials provided by the Client
• Backups that were not tested by the Client
• Unavailability of the Client's systems (FTP servers, websites, databases)
• Indirect, incidental or consequential damages

6. Payments and Subscriptions

• Paid plans are billed on a recurring basis (monthly or annually) via Stripe
• The Client may cancel the subscription at any time; the service remains active until the end of the paid period
• We do not offer prorated refunds for unused periods
• Baristta reserves the right to change prices with 30 days advance notice

7. Suspension and Termination

Baristta may suspend or terminate the Client's access in the following cases:

• Violation of these Terms of Service
• Abusive use of the platform
• Payment default after notification
• Activities that put the platform or other clients' security at risk

In case of suspension due to payment default, access will be restored after payment regularization. In case of termination, data will be retained for 30 days before permanent deletion.

8. Intellectual Property

The Baristta platform, including its source code, design, brand and documentation, is the exclusive property of Macchiatto Tecnologia. The Client retains all rights to their own data and content. Baristta does not acquire any rights over the Client's data beyond what is necessary for the provision of contracted services.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Baristta's total liability for any damages arising from the use of the platform is limited to the amount paid by the Client in the last 12 months of subscription.

10. Changes to Terms

Baristta may modify these Terms of Service at any time. Significant changes will be communicated with 30 days advance notice by email or notice on the platform. Continued use of the platform after changes take effect constitutes acceptance of the new terms.

11. Governing Law

These Terms of Service are governed by the laws of the Federative Republic of Brazil. Any disputes shall be resolved in the courts of Baristta's domicile jurisdiction, to the exclusion of any other.
